These Terms of Sale apply to every order you place with Boo Inc. ("Boo", "we", "us") through theboo.ai. By placing an order you agree to these terms, our Order & Refund Policy, Shipping Policy and Limited Warranty. Please read them carefully.
1. Who you're buying from
You're buying from Boo Inc., a corporation organized in the State of Georgia, USA. You must be at least 18 years old, or the age of majority where you live, to place an order.
2. Orders before shipping
Boo is launching soon and is not on sale yet. When it is, an order may reserve a unit that has not shipped yet. We ship orders in the order they were placed. Any ship date we give is an estimate. If we can't ship within the time we told you, or within 30 days if we didn't give a time, we'll tell you, give you a revised date, and let you cancel for a full refund. If you don't respond, we'll keep your order unless the law requires otherwise. Details are in our Order & Refund Policy.
3. Prices and payment
- Prices are in US dollars. Shipping within the US is free unless stated otherwise at checkout.
- Applicable sales tax, if any, is added where required by law.
- Your payment card is charged when you place your order. Payments are processed by our payment processor, Authorize.net. We do not receive or store your full card number.
- We may limit quantities per customer. The current limit is 3 units per order.
- If a price or product is listed in error, we may cancel any orders placed at that price and refund you in full.
4. Order acceptance
Your order is an offer to buy. We accept it when we send you an order confirmation email. We may refuse or cancel an order, for example because of suspected fraud, a pricing error, or if we can't ship to your address. If we cancel, we refund anything you paid.
5. Shipping, title and risk
We ship to addresses in the 50 US states and Washington, DC. Title and risk of loss pass to you when the carrier delivers your order. See our Shipping Policy.
6. Cancellations, returns and refunds
You can cancel an order any time before it ships for a full refund. After delivery, you can return Boo within 30 days. See our Order & Refund Policy.
7. Warranty
Boo hardware comes with the Boo Limited Warranty. Except for that warranty and any rights you have by law that can't be waived, Boo is provided "as is".
8. Limitation of liability
To the fullest extent permitted by law, Boo Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your purchase or use of Boo. Our total liability for any claim relating to a product is limited to the amount you paid for that product.
Some states don't allow these limitations, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection laws that can't be waived by contract.
9. Governing law and disputes
These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Before filing a claim, please contact us at info@theboo.ai so we can try to resolve it informally. Any dispute that isn't resolved informally will be brought in the state or federal courts located in Georgia, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court where it qualifies.
10. Changes
We may update these terms from time to time. The version in effect when you place your order applies to that order.
